Shoulder Monitor LLC (hereinafter “Shoulder Monitor”) is committed to protecting the privacy of its customers (hereinafter “Customer”). This Privacy Policy provides a description of the Customer’s personal information collected, entered, and/or measured during use of Shoulder Monitor’s services, such as at an affiliate partner location,(collectively, “the Service”), during access of the Service via the Company’s web site (hereinafter “Site”) at www.live-arm.com, and/or during access of the Company’s LiVE ARM mobile device application (hereinafter “Application”), as well as how the information is used.

This Privacy Policy was last updated March 31, 2025 and forms part of the Terms of Use of the Service, Site, or Application. By using the Service, Site, or Application, Customer agrees to the collection and use of information, in accordance with this Privacy Policy.

INFORMATION COLLECTED AND USE

While using the Service, Site, or Application, Shoulder Monitor may collect either personal information, which identifies a Customer, or non-personal information which does not directly identify a Customer.

Types of Information Collected
The information collected can include name, age, height, date of birth, email address, skill level, injury history, pitching experience, member or account username and password, and strength measurements obtained with the LiVE ARM device. Also, derived from these measurements, fatigue data. When a Customer utilizes the Service provided by Shoulder Monitor or accesses the Service via the Site and/or via the Application, certain information may be automatically collected. For example, the IP address or mobile device identifier as utilized by the Customer, the service provider, the web browser, or the frequency with which the Customer accesses the Site may be collected by Shoulder Monitor or by another party using cookies or other technologies.

How the Information Is Collected
The Customer information will be collected where the LiVE ARM device is utilized. Data physically entered into Shoulder Monitor’s central database where all corresponding data (i.e., Customer information and baseball statistics) can be accessed by the Customer via a membership.

How the Information Will Be Used
The information will be used to determine the Customer’s shoulder fatigue, and to correlate that data with the other information provided by the Customer. This information may help identify more precise means of identifying pitchers who are at risk of injury.

Shoulder Monitor may use the personal information to communicate with the Customer to provide promotional or marketing materials, to provide requested products or services, or to provide information regarding Customer’s membership.

We may share your information with:

Coaches and Team Staff
With your consent, we may share your performance and health data with designated coaches, trainers, or medical staff.

Service Providers
We may engage trusted third parties to perform services on our behalf, such as hosting, data analysis, and customer service. These providers have access to your information only to perform these tasks and are obligated to maintain confidentiality.

Legal Requirements
We may disclose your information if required by law, legal process, litigation, or governmental authorities.

Business Transfers
If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction.

DATA RETENTION

We retain your information for as long as your account is active or as needed to provide you services. We may retain certain information for legitimate business purposes or as required by law.

MINORS

Our services are intended for users who are 13 years of age or older. If you are a parent or guardian and believe your child under 13 has provided us with personal information without your consent, please contact us. We do not knowingly collect information from children under 13.

Shoulder Monitor reserves the right to modify the Privacy Policy at any time. Customer’s continued use of the Service, Site, and/or Application constitutes an acceptance of any modifications to the Privacy Policy.
